Border Agency Acted in ‘Bad Faith’ When it Fired Employee Over $26 Million Loss: Labour Board

CBSA accused of shielding others and failing to conduct a proper investigation

The Canada Border Services Agency (CBSA) has been accused of “deceitfully” firing an employee without a proper investigation after the agency failed to collect around $26 million in duties. The Federal Public Sector Labour Relations and Employment Board ruled that CBSA acted in bad faith and failed to conduct a thorough investigation before terminating the employee, Anne Kline, in 2018.

Kline, who was accused of negligence leading to the loss of millions in duties, was later exonerated. The labour board found that CBSA’s disciplinary process was flawed and seemed designed to protect others while unfairly targeting Kline. Despite her victory, Kline described the firing as deeply hurtful and damaging to her self-confidence.
